While preparing for the new Whistleblowing Act, little has been said so far about the fact that in addition, the Misdemeanour Act will also be amended, envisaging\u00a0a fine of up to HUF 200,000 if the company takes adverse action against the whistleblower or prevents or attempts to prevent <\/strong>whistleblowing<\/strong><\/a>.<\/strong><\/p>\n

We have already written about\u00a0who are concerned by the Whistleblowing Act<\/a>, now let\u2019s look at the sanctions for breaching the Act and\u00a0how to avoid them with the help of a whistleblowing attorney.<\/strong><\/p>\n

In what cases are we committing an offence?<\/strong><\/h2>\n

According to the amendment of the Misdemeanour Act,\u00a0an offence is committed in the following cases:<\/u><\/p>\n

1. The company takes adverse action against the whistleblower.<\/strong><\/h3>\n

An adverse action can be any retaliation against the whistleblower, such as threatening or dismissing the whistleblower.<\/p>\n

2. The company prevents or attempts to prevent whistleblowing.<\/strong><\/h3>\n

Such cases include, when the company<\/p>\n

\u2013 physically or by virtue of IT actions frustrates the submission of a report, or
\n\u2013 effectively blocks the investigation of the report.<\/p>\n

What sanctions can we face in case of breaching the Whistleblowing Act?<\/strong><\/h2>\n

In the above cases the person(s) committing these actions may be fined<\/strong>.\u00a0The amount of the fine can range from HUF 6,500 to HUF 200,000.<\/strong><\/p>\n

How can a whistleblowing attorney help you?<\/strong><\/h2>\n

You can easily avoid the sanctions mentioned above by hiring an attorney.<\/strong><\/p>\n

A whistleblowing attorney acts as a bridge between the anonymous whistleblower and the company,\u00a0and his or her tasks include<\/u>:<\/p>\n

\u2013 receiving whistleblower reports related to the client\u2019s activities,
\n\u2013 providing legal advice to the whistleblower on how to make a report,
\n\u2013 liaising with the whistleblower,
\n\u2013 if necessary, (s)he may request information and clarification from the whistleblower,
\n\u2013 assisting in the conduct of an investigation following a notification,
\n\u2013 updates the parties on events relating to the notification,
\n\u2013 reports on the outcome of an investigation initiated following a notification.<\/p>\n
