{"id":28421,"date":"2023-10-11T08:38:12","date_gmt":"2023-10-11T08:38:12","guid":{"rendered":"https:\/\/visegradlegal.hu\/?p=28421"},"modified":"2024-01-21T09:15:02","modified_gmt":"2024-01-21T09:15:02","slug":"fines-for-sanctioning-or-frustrating-whistleblowing","status":"publish","type":"post","link":"https:\/\/visegradlegal.hu\/en\/compliance-2\/fines-for-sanctioning-or-frustrating-whistleblowing\/","title":{"rendered":"Fines of up to HUF 200,000 for sanctioning or frustrating whistleblowing"},"content":{"rendered":"<p>While preparing for the new Whistleblowing Act, little has been said so far about the fact that in addition, the Misdemeanour Act will also be amended, envisaging\u00a0<strong>a fine of up to HUF 200,000 if the company takes adverse action against the whistleblower or prevents or attempts to prevent <\/strong><a href=\"https:\/\/visegradlegal.hu\/en\/eu-law\/a-new-wind-is-blowing-through-whistleblowing\/\"><strong>whistleblowing<\/strong><\/a><strong>.<\/strong><\/p>\n<p>We have already written about\u00a0<a href=\"https:\/\/visegradlegal.hu\/en\/eu-law\/a-new-wind-is-blowing-through-whistleblowing\/\">who are concerned by the Whistleblowing Act<\/a>, now let\u2019s look at the sanctions for breaching the Act and\u00a0<strong>how to avoid them with the help of a whistleblowing attorney.<\/strong><\/p>\n<h2><strong>In what cases are we committing an offence?<\/strong><\/h2>\n<p>According to the amendment of the Misdemeanour Act,\u00a0<u>an offence is committed in the following cases:<\/u><\/p>\n<h3><strong>1. The company takes adverse action against the whistleblower.<\/strong><\/h3>\n<p>An adverse action can be any retaliation against the whistleblower, such as threatening or dismissing the whistleblower.<\/p>\n<h3><strong>2.
